Недопустимость Доказательств Следствие Неустранимых Нарушений Закона При Собирании Доказательств

Abstract

Автор считает, что буквальное толкование пункта 3 части второй ст.75 УПК РФ обязывает субъекта доказывания признавать недопустимыми доказательствами все, которые получены с нарушением закона, вне зависимости от существенности такого нарушения. Подобный подход к определению оценки недопустимости доказательств, по мнению автора, нуждается в существенном дополнении. В статье приводятся предложения по пополнению действующего закона в этой части доказывания, приводятся обоснования предложений.
