Abstract

В данной статье рассмотрен сравнительно-правовой анализ проблем разграничения договорной и деликтной ответственности за вред, причиненный вследствие недостатков товаров, работ или услуг по действующему законодательству РФ. Проанализированы характерные особенности разграничения договорной и деликтной ответственности за вред причиненный вследствие недостатков товаров, работ или услуг. Выявлена и обоснована необходимость деление обязательств на договорные и деликтные. На основе проведенного исследования автором предлагается выделить, что критерием разграничения договорной и деликтной ответственности в случае причинения вреда недостатком товара является направленность вредоносного результата
