Abstract

В статье на основе действующего и ретроспективного уголовного и уголовно-процессуального законодательства России, и судебной практики определяется процессуальная форма освобождения от наказания в связи с изменением обстановки. Сформулированы предложения и рекомендации по совершенствованию уголовно-процессуального закона и правоприменительной практики.
