Соотношение Понятий «Франчайзинг» И «Коммерческая Концессия»

Abstract

В настоящей статье освещается проблема определения понятия коммерческой концессии как гражданско-правового договора и способа осуществления предпринимательской деятельности, проводится соотношение с понятием франчайзинга, использующимся для определения аналогичных видов договоров в ряде иностранных государств. В статье производится анализ терминов «коммерческая концессия» и «франчайзинг», сравниваются точки зрения, высказанные в литературе различными авторами. По результатам проведенного исследования автором формулируется вывод относительно соотношения рассматриваемых понятий
