Abstract

Статья посвящена актуальным вопросам реализации такого принципа гражданского права как свобода договора. Охарактеризовав перечень ее форм, автор обращает внимание на необходимость их защиты от имеющихся злоупотреблений свободой договора. В связи с этим подчеркивается необходимость определения и закрепления пределов (границ) договорной свободы, а также критериев допустимости (недопустимости) того или иного варианта ее использования при определении условий и реализации договорных связей.
