Право На Обжалование: Благо Или Вред?

Abstract

Большинство ученых-процессуалистов рассматривают институт обжалования действий и решений должностных лиц, осуществляющих досудебное производство как благо для обеспечения возможности заинтересованным лицам восстановить свои нарушенные права или реализовать свой интерес в уголовном деле. Соглашаясь в целом с данной позицией, все же следует выделить и несовершенство данного правового института. Практика применения уголовно-процессуального законодательства выявила негативные стороны «неограниченного» права на обжалования. Эти проблемы и рассматриваются в данной статье.
