О Совершенствовании Административно-Правового Регулирования Частной Детективной И Охранной Деятельности, Оборота Гражданского И Служебного Оружия В Российской Федерации

Abstract

В указанной работе автор подвергает критическому анализу нормативную правовую базу и правоприменительную практику органов внутренних дел в сфере оборота гражданского и служебного оружия, а также в частной детективной и охранной деятельности. Автор считает, что последующие изменения в российском законодательстве об обороте гражданского и служебного оружия, о частной детективной и охранной деятельности должны быть направлены не столько на ужесточение условий и требований разрешенной деятельности, сколько на упорядочение существующих правоотношений, особенно в части реализации законных интересов и установления четких юридических обязанностей сторон. В рамках статьи проанализированы отдельные аспекты правоприменительной практики органов внутренних дел в указанных сферах, выявлены очевидные пробелы в законодательстве. Предложены возможные пути по совершенствованию административно-правового регулирования частной детективной и охранной деятельности, оборота оружия в Российской Федерации.
