Abstract

В настоящей статье исследуется вопрос о возможности пересмотра по новым обстоятельствам вступившего в законную силу судебного акта в отношении лица, которое не обращалось в Конституционный Суд РФ, однако его дело является идентичным тому, по которому принято решение Конституционного Суда РФ о признании закона, примененного в деле, несоответствующим Конституции Российской Федерации.
