Abstract

В статье рассмотрены положения, указанные в ст. 43 Основ законодательства РФ об охране здоровья граждан. Нарушение указанных в ст. 43 условий должно повлечь наступление ответственности медицинских работников за незаконное проведение медицинских экспериментов над человеком. Поскольку проведение экспериментов над человеком всегда ставит под угрозу причинения вреда его жизни и здоровью, в статье делается вывод, что ответственность за незаконное экспериментирование должна быть уголовной, а не административной, и тем более не дисциплинарной.
