Abstract

В данной статье на основе изучения теоретических положений и судебной практики обоснована актуальность рассмотрения сущности объектов жилищных прав. Критический анализ законодательной базы, существующих авторских подходов к определению самостоятельных объектов жилищных прав позволил заключить, что часть жилого дома и часть квартиры могут рассматриваться в качестве самостоятельных объектов жилищных прав и требуют соответствующего законодательного закрепления с целью обоснованного учета в гражданском обороте.
