Механизм Правового Обеспечения И Реализации Равного Доступа Женщин К Военной Службе

Abstract

Представляется, что в Федеральный закон «О воинской обязанности и военной службе» (в проект Федерального закона «О военной службе») следовало бы внести следующую норму: «в перечнях воинских должностей определяются воинские должности, которые не могут замещаться военнослужащими женского пола». Предлагается создание одного перечня: Перечня воинских должностей, которые не могут замещаться военнослужащими женского пола. Наша точка зрения по исследуемому вопросу сводится к тому, что предлагаемый перечень необходимо создать на основании критериев, научно обоснованных с медицинской точки зрения, оказывающих отрицательное влияние на репродуктивную функцию женщин и не противоречащих нормам части 3 статьи 55 Конституции Российской Федерации.
