Муниципальное Образование Как Субъект Правонарушения

Abstract

В статье исследуются вопросы юридической ответственности муниципального образования как самостоятельного субъекта. При анализе российского законодательства основное внимание автор обращает на то, что в качестве субъекта ответственности рассматриваются непосредственно органы местного самоуправления, их должностные лица даже в тех случаях, когда неблагоприятные последствия очевидно наступают для муниципалитета в целом. Анализ отечественного права дополняется практикой регламентации некоторых аспектов ответственности местной власти за рубежом.
