О Регистрации Юридических Лиц В России

Abstract

Место регистрации юридических лиц является весьма важной проблемой, особенно для малых предприятий. Согласно действующему законодательству местом регистрации юридического лица может быть место жительства его единоличного исполнительного органа, например в лице генерального директора. Показано, что отказ налоговых органов в такой регистрации не правомерен. Процедура регистрации юридических лиц в России весьма сложна и носит разрешительный характер. Тогда как во многих странах за рубежом такая регистрация носит уведомительный характер. Упрощению регистрации юридических лиц в России может послужить отмена предоставления в регистрирующий орган устава создаваемого юридического лица. Показано, что в этом нет никакой необходимости.
