Дефектность Юридического Состава, Возникающая Без Правонарушения При Заключении Договора

Abstract

Статья посвящена вопросам дефектности юридического состава, возникающая без правонарушения при заключении договора. В рамках статьи анализ проблемы дается в комплексе с такими правовыми явлениями как незаключенность договора и отклонение от юридической процедуры заключения договора. Такой подход предоставил возможность системно анализировать исследуемые автором проблемы. На основании проведенного анализа в статье даются рекомендации для совершенствования действующего гражданского законодательства. Особое внимание в статье уделено преодолению пробелов в законодательстве в сфере норм о заключении договоров, как порядка формирования юридического состава. Проблемы, исследуемые в рамках научной статьи, имеют как теоретическое значение, так и сугубо практическое.
