Abstract

в предлагаемой статье автор анализирует концепции, связанные с ограничением свободного усмотрения в гражданском праве. В статье автор приходит к выводу, что в качестве критериев ограничения свободного усмотрения могут выступать: добрые нравы, добросовестность, общественные интересы, экономическая справедливость. Эти критерии, могут закрепляться не в качестве основных начал гражданского права, но для определения границ усмотрения в конкретных правоотношениях или в качестве ориентиров для введения законодателем новых ограничений.
