Специфика Гражданско-Правовой Ответственности Некоммерческой Организации

Abstract

В представленной статье анализируется специфика гражданско-правовой ответственности некоммерческой организации. Автор делает вывод, что некоммерческие организации несут ответственность наравне с другими субъектами права. Основанием юридической ответственности является правонарушение, а возложение ответственности возможно лишь в определенном процессуальном порядке. Следует отметить, что такая разновидность некоммерческой организации, как общественные объединения, подлежат ответственности не только за деяния, наносящие ущерб интересам государства, но и за решения и действия, ущемляющие права граждан, которые пользуются в данном случае судебной защитой. При исследовании вопроса об ответственности в статье уделено внимание новой цивилистической категории конфликту интересов в некоммерческой организации. Рассматриваются пути решения основных тенденций гражданско-правовой ответственности в системе некоммерческих организаций.
