Abstract

В статье рассмотрены подходы российских ученых к поставленной проблеме. Автор пришел к выводу, что до сегодняшнего дня данная проблема так и не разрешена доктринально, но в юридической практике, можно утверждать, судебный прецедент уже de facto является её источником. В юридической деятельности он активно применяется в качестве нормативного источника решения дел высшими судами России.
