Использование Помещения В Хозяйственной (Экономической) Деятельности

Abstract

В статье раскрываются и анализируются актуальные вопросы возможности использования помещения в хозяйственной (экономической) деятельности, а также исследуются разрешенные действующим законодательством режимы использования жилого помещения в хозяйственной (экономической) деятельности с условием его перевода в нежилое и без такового. Доказывается, что отсутствие легального понятийного аппарата и используемой законодателем терминологии («промышленное производство», «предприятие», «организация», «учреждение») приводит к тому, что практически предоставленные законодателем права, а именно п.3 ст.288 ГК РФ и ст.17 ЖК РФ, ставятся под сомнение. Делается вывод о необходимости пересмотреть ст.132 ГК РФ, и определить предприятие не только как имущественный комплекс, но и как самостоятельный объект гражданских прав. Внесены предложения по совершенствованию действующего законодательства.
