Abstract

В статье рассматриваются проблемные аспекты определения международного преступления агрессии в Уголовном кодексе РФ (ст.ст. 353 и 354) и международном уголовном праве. На основании анализа действующего законодательства и научно-теоретических источников автор делает вывод о том, что законодательная конструкция «агрессивная война» является несовершенной и необоснованной по отношению к соответствующим нормам международного права. Таким образом, возникает необходимость дать законодательное определение понятия агрессивной войны.
