Abstract

В статье определяется роль суда, как самостоятельной и независимой ветви власти, признанной организовать такой процесс, в котором для участников были бы созданы все условия реализации своих процессуальных прав и выполнения процессуальных обязанностей. Решения вышестоящих судов реализуют российское законодательство, дополняют пробелы в законе.
