Виды Умысла И Их Влияние На Квалификацию

Abstract

В статье рассматриваются вопросы привлечения к уголовной ответственности за преступления, совершенные с разными видами умысла. Анализируется с точки зрения практической ценности правило об ответственности либо за наступивший результат (при косвенном умысле), либо за желаемый результат (при прямом умысле). Определяется юридическое значение прямого неопределенного умысла в тех случаях, когда преступные действия виновного не привели ни к одному из желаемых им последствий или вызвали не наиболее тяжкое последствие. Затрагивается комплекс проблем, возникающих при квалификации преступлений, совершаемых с аффектированным и специальным умыслом.
