Проблемы Определения Подведомственности По Делам Об Административных Правонарушениях В Сфере Жилищного Строительства

Abstract

Предлагаемая работа на тему «Особенности определения подведомственности по делам об административных правонарушениях в сфере жилищного строительства» посвящена актуальным проблемам практики применения административной ответственности за нарушение законодательства в сфере жилищного строительства. По мнению автора, недостаточно корректная формулировка статьи 23.1 Кодекса РФ об административных правонарушениях (далее КоАП РФ) вызывает сложности правоприменения. Сложности возникают с вопросом определения субъектов производства по делам об административных правонарушениях, предусмотренных статьей 9.5.1 КоАП РФ, так как между частью 2 и абзацем 3 части 3 статьи 23.1 КоАП РФ существуют противоречия, преодоление которых автор предлагает в своей работе.
