К Вопросу О Возможности Реализации Конституционного Принципа Самостоятельности Местного Самоуправления

Abstract

В статье рассматривается вопрос о возможности реализации конституционного принципа самостоятельности местного самоуправления. Проведя анализ российского законодательства и ознакомившись с мнением ведущих российских правоведов, автор приходит к выводу, что конституционный принцип самостоятельности местного самоуправления не утверждает суверенитет муниципальных образований. Данная норма является лишь нормативно-руководящим началом для развития и закрепления гарантий местного самоуправления в федеральном законодательстве, законодательстве субъектов федерации и других нормативных правовых актах. Автор дает свое определение термину «конституционный принцип самостоятельности местного самоуправления».
