Государственно-Частное Партнерство Как Объект Институционального Анализа: К Вопросу О Систематизации Формальных Институтов

Abstract

В статье рассматриваются подходы к содержанию категории «государственно-частное партнерство» и классификация видов ГЧП, существующие в отечественной и зарубежной литературе. Выявляется институциональная природа данного явления с позиций специфичности активов и принятия мер предосторожности в связи с угрозой оппортунизма. Приводятся ключевые институты, регламентирующие ГЧП на федеральном уровне (как действующие, так и проекты нормативных актов), показан их уровневый характер. Осуществляется сравнительная характеристика действующего законодательства в области ГЧП по таким параметрам, как характеристика субъектов взаимодействия, объект регулирования, тип контракта, права и обязанности сторон. Отмечается превалирование в законодательстве интересов и выгод публичной стороны.
