Конфликт Интересов В Саморегулируемых Организациях Сша И Неэффективность Финансового Рынка

Abstract

В статье изучается проблема конфликта между коммерческими и регулятивными интересами СРО с точки зрения предпочтений профучастников-членов в отношении эффективности финансового рынка. Для выявления глубины конфликта на основе разработанных методов были определены индивидуальные предпочтения профучастников на примере США за период с 1991 по 2010 гг. В результате установлено, что максимальную накопленную стоимость портфелей профучастники получали в области систематических отклонений рынка от нормальности (эффективности). Цели по максимизации полезности профучастников за определенный период принципиально не совпадали с целями СРО по регулированию рынка, соответствующими требованиям суверенного регулятора и международных организаций. Разработанные методы и полученные результаты могут быть использованы при принятии решений о распределении полномочий регулирования финансового рынка между СРО и суверенным регулятором.
