Применение Утилизационного Сбора В Отношении Колесных Транспортных Средств

Abstract

Утилизационный сбор, введенный в Российской Федерации с принятием дополнений для главы V Федерального закона от 24 июня 1988 г. №89-ФЗ «Об отходах производства и потребления», представляет собой определенный вид налога, уплачиваемого различными категориями плательщиков на колесные транспортные средства с целью обеспечения их утилизации после выбытия из эксплуатации. Несмотря на то что официальной целью введения сбора является защита окружающей среды, есть основания полагать, что в действительности он был введен для защиты национальных автопроизводителей, а также изготовителей, осуществляющих деятельность на территории России, в связи с чем сбор в некоторой части не соответствует правилам и нормам ВТО, и идет в разрез с обязательствами, взятыми Россией при вступлении в эту организацию. Данная статья посвящена краткому анализу основных аспектов применения данного сбора в контексте обязательств России в рамках ВТО.
