Особые Мнения Судей И Вто: Упущенные Возможности

Abstract

Возможность изложения особого мнения является одной из гарантий независимости международных судей. Особые мнения способствуют развитию международного права. В рамках Органа по разрешению споров ВТО члены третейских групп и арбитры Апелляционного органа могут излагать особые мнения, но только анонимно. Именно этим объясняется то, что право изложения особых мнений в рамках ВТО было использовано лишь несколько раз.
