Судебная Почерковедческая Экспертиза Как Форма Применения Специальных Знаний

Abstract

Статья посвящена судебной почерковедческой экспертизе как форме применения специальных знаний. В статье излагаются мнения известных криминалистов о понятии «специальные знания». Автор придерживается точки зрения, в которой специальные знания определяются как «знания в области науки, искусства или ремесла, приобретенные при получении специального образования или в процессе практической работы по конкретной специальности». Рассматривается возможность производства экспертизы до возбуждения уголовного дела и отсутствие уголовно-правовых гарантий как проблема регулирования судебной экспертизы на стадии возбуждения уголовного дела; вопросы, связанные с технико-криминалистической экспертизой документов и возникающие при производстве почерковедческих экспертиз.
