Abstract

Статья посвящена процессуальным и криминалистическим вопросам использования электронных носителей компьютерной информации в уголовном процессе, в качестве доказательства иных документов. Анализируются нормы материального права, уголовнопроцессуального законодательства, регулирующие статус документов, а также криминалистическая литература, посвященная данной проблеме. Делается вывод о наличии противоречий между подходами к пониманию документа в уголовном процессе и криминалистике и в материальном праве. Предлагаются критерии разграничения в уголовном процессе и криминалистике электронных документов и недокументированной компьютерной информации.
