Abstract

Статья представляет собой правовую характеристику условий правомерности необходимой обороны от действий, сопряженных с опасным для жизни насилием (непосредственной угрозой его применения). Проанализированы законодательные формулировки и положения акта официального толкования на предмет их достаточности, целесообразности и соответствия принципу гарантированности права на необходимую оборону. Выявлены некоторые недочеты и пробелы правового регулирования, предложены способы их устранения.
