Abstract

Анализируется состояние научной разработанности частной криминалистической методики расследования преступлений, связанных с организацией незаконной миграции. Рассматривая дискуссионные вопросы, выступающие предметом научной полемики, связанные с формированием указанной частной криминалистической методики, автор особое внимание уделяет криминалистической характеристике преступлений. Элементный состав данной научной категории применительно к исследуемой категории преступлений не отличается единообразием. На основе анализа различных точек зрения автор представил собственную позицию о структуре элементов криминалистической характеристики организации незаконной миграции, включающей совокупность коррелятивно взаимосвязанных компонентов.
