Заключение Эксперта По Судебно-Баллистическим Экспертизам В Системе Доказательств По Уголовным Делам

Abstract

Рассматривается судебно-баллистическое экспертное заключение как доказательство и его значение в установлении фактов, необходимых для всестороннего и полного изучения обстоятельств уголовного дела, относящихся к предмету доказывания. Отмечается, что факты, устанавливаемые при производстве судебно-баллистической экспертизы, в одних случаях могут относиться к предмету доказывания (главные факты), в других имеют лишь промежуточный характер (промежуточные факты), способствуя установлению обстоятельств, входящих в предмет доказывания. Определяется соотношение главных фактов и промежуточных фактов, устанавливаемых посредством судебно-баллистической экспертизы. Приводятся критерии оценки достоверности экспертного заключения.
