Abstract

Предпринята попытка раскрыть правовую природу механизма права на судебную защиту, его взаимосвязь с результатом реализации принципов, закрепленных в Конституции и международной Конвенции о защите прав человека и основных свобод, а также взаимосвязь с ограничением возможности самостоятельного применения принуждения в отношении других лиц.The article attempts to reveal the mechanism of the legal nature of the right to judicial protection, its relationship with the result of the implementation of the principles enshrined in the Constitution and the International Convention for the Protection of Human Rights and Fundamental Freedoms, and the relationship with disabilities independent use of coercion against others.
