Проблемы Правовой Оценки Деятельности Руководителей Организаций При Злоупотреблении Полномочиями И «Выводом» Активов Компании

Abstract

Рассмотрены проблемы разрешения споров и расследования дел, связанных с фактами злоупотребления руководителями организации своими полномочиями. Итогом такой деятельности, как правило, становится «вывод» активов компании, нарушение имущественных прав участников. Борьба с подобными правонарушениями осуществляется нормами различных отраслей права. Необходимо при выборе способа и формы защиту нарушенных прав давать верную оценку, как действий руководителя, так и криминологическую характеристику его личности.
