Служащие Как Субъекты Коррупционных Преступлений

Abstract

В статье рассматриваются особенности привлечения к уголовной ответственности государственных, муниципальных и иных служащих за совершение коррупционных преступлений. Устанавливается содержание признака «использование лицом своего служебного положения» на основе определения его субъектного состава. Подчеркивается, что не все служащие могут нести ответственность за коррупцию, так как комплекс их прав и обязанностей не свидетельствует об их существенном вкладе в реализацию функции управления в обществе и тем самым о повышении степени общественной опасности их преступной деятельности.
