Принцип Юридического Равенства Участников Гражданских Правоотношений В Розничной Купле-Продаже

Abstract

Термин " равенство" имеет несколько значений. Различают социальное, экономическое и юридическое равенство субъектов. В статье раскрывается содержание принципа юридического равенства участников гражданских правоотношений. Анализируются различные точки зрения относительно содержания юридического равенства и отнесения категории юридического равенства к предмету гражданского права, методу гражданского права или принципам гражданского права. Рассматриваются формы проявления принципа юридического равенства участников гражданских правоотношений в договоре розничной купли-продажи и их ограничения. Объясняется необходимость введения ограничений принципа юридического равенства в договоре розничной купли-продажи посредством сглаживания фактического неравенства продавца и покупателя, предоставлением им равных возможностей для осуществления прав и защиты потребителя как слабой стороны обязательства.
