Abstract

Рассматриваются логические аспекты применения аналогии в юридическом доказывании, закрепленном в действующем процессуальном законодательстве, их соответствие правилам логического вывода. Необходимость соблюдения основных принципов логической аргументации в процессуальном доказывании обусловлена не только юридическими императивами процессуальных норм, но объективными закономерностями человеческого мышления. В данной статье уделяется внимание использованию аргументации по аналогии в процессе доказывания и важности соблюдения при этом принципов недемонстративных умозаключений.
