Некоторые Проблемы, Связанные С Определением Круга Лиц, Ответственных За Совершение Налоговых Преступлений

Abstract

Рассматриваются некоторые вопросы определения круга лиц, могущих нести ответственность за налоговые преступления. Особое внимание уделяется перспективам привлечения к ответственности учредителей и «теневых руководителей» организаций, осуществляющих уклонение от налогообложения, а также проблеме взаимозависимых лиц. Содержатся примеры типовых ситуаций, связанных с уходом от ответственности за правонарушения в сфере налогообложения. Предлагаются пути развития уголовного права, основанные на частичной рецепции институтов налогового и корпоративного права, в частности концепции «консолидированных групп».
