Abstract

Статья посвящена анализу процедуры оценки конкурентной среды при рассмотрении ФАС РФ ходатайств об одобрении сделок экономической концентрации, представлен анализ положений и практики применения Порядка оценки конкурентной среды, используемого ФАС РФ, выявлены его основные недостатки, представлены рекомендации по повышению качества экономического анализа при анализе рынка и конкурентной среды, предложены дополнительные методы ее оценки, основанные на ведущих зарубежных практиках, а также концепция анализа изменения совокупного общественного благосостояния в результате сделки. В заключении также представлены предложения по усовершенствованию процедуры принятия решений об одобрении либо запрете сделок M&A
