Страхование В Мусульманском Мире: К Истории Вопроса

Abstract

В статье представлена краткая история развития страховых отношений в мусульманском мире. По мере развития страхового бизнеса в среде мусульман все острее ставился вопрос о соответствии страхования шариату. Ханафитский (Hanafi) юрист (scholar) Ибн Б??Абидин (Ibn Б??Abidin) (1784Б??1836) объявил подобную практику недозволенной с точки зрения шариата. Однако если договор страхования был заключен в немусульманской стране, мусульманин владелец груза имел право требовать возмещения стоимости имущества в случае его утраты или порчи. В дальнейшем мусульманские правоведы ссылались на мнение Ибн Б??Абидина, объявляя нелегитимным не только морское страхование, но и другие виды страховой защиты. Однако были правоведы, которые объявляли страховую практику дозволенной, независимо от того, где был заключен договор: в мусульманской или немусульманской стране. Например, Мухаммад Б??Абду (Б??Абдо) (Muhammad Б??Abdu), объявивший страхование жизни дозволенным с точки зрения шариата. Однако большинство мусульманских правоведов в Новое время придерживалось точки зрения Ибн Б??Абидина
