Содержание Тайны Голосования Как Разновидности Правового Режима Информации В Российском Государстве

Abstract

Исследование содержания тайного голосования невозможно без определения понятия «тайна голосования». В законодательстве Российской Федерации общеправовое понятие «тайна» не закреплено, в связи с чем в правовой литературе встречается два основных подхода к указанному понятию: тай-на как информация и тайна как правовой режим информации. Цель. Основная цель состоит в анализе тайного голосования как правового режима информации. Результаты. В связи с отсутствием законодательного закрепления понятия «правовой режим информации» для его исследования изучены понятия «информация» и «правовой режим». На основе анализа основных элементов правового режима информации сделан вывод о том, что все они присущи тайне голосования. Заключение. Сделаны выводы о содержании тайны голосования, на основании чего определена ценность скрываемых сведений.
