Интернет В Предметном Поле Юридической Науки: Проблемы Теории

Abstract

Введение. В статье рассматриваются методологические аспекты формирования теоретической модели Интернета в отечественной юридической науке. Результаты. По мнению автора, операционализация идеализированного объекта Интернета формируется на базе его технических свойств артефакта, социальные аспекты Интернета остаются вне фокуса внимания методологов информационного права. Обсуждение. Автор приходит к выводу о том, что данная ситуация требует методологических корректировок, позволяющих зафиксировать и социальные аспекты Интернета, в том числе и в динамической перспективе, его способность быть инструментом установления практически любых правоотношений. В этом отношении плодотворным будет использование накопленных коммуникативистикой знаний о моделях и типах интернет-коммуникации.
