О Роли Системного Подхода В Исследовании Гражданско-Правовых Договоров

Abstract

В статье рассматривается вопрос значимости использования системного подхода при изучении природы гражданско-правовых договоров и сущности договорного регулирования. Автор высказывает мнение, что классификация договоров, основанная на использовании системных признаков, способствует решению проблемных вопросов договорного регулирования, облегчает выбор субъектами вида договора, обеспечивает соответствие условий договора содержанию регулируемой деятельности. Таким образом, появляется возможность на научной основе систематизировать законодательство о договорах, повысить согласованность нормативных актов, решить проблемы правоприменительного характера.
