К Вопросу О Сущности Преступного Сообщества (Преступной Организации), Создаваемого В Целях Осуществления Нелегального Наркобизнеса

Abstract

В статье проанализированы признаки преступного сообщества (сплоченность, устойчивость, совершение тяжких и особо тяжких преступлений, вхождение в его состав нескольких организованных групп). Выявлены некоторые проблемы в регламентации ответственности членов преступного сообщества, созданного в целях осуществления нелегального наркобизнеса. Названы признаки преступного сообщества в сфере наркобизнеса (совместность совершения преступной деятельности, высокий уровень знаний и навыков участников, наличие структурной и функциональной иерархичности и др.). В целях совершенствования уголовного законодательства в сфере борьбы с организованной преступностью и наркобизнесом автор предлагает дополнить УК РФ статьей «Организация преступного сообщества (преступной организации) в целях осуществления наркобизнеса».
