Виктимность Пострадавшего При Несчастных Случаях На Производстве: Условия Ответственности, Несудебная Защита Трудовых Прав

Abstract

В статье исследуются малоизученные в трудовом праве проблемы виктимности пострадавшего и их влияние на ответственность работодателя. Авторы предлагают разграничить степень ответственности должностных лиц работодателя при наступлении несчастного случая на производстве, ввести обязательное юридическое образование для членов комиссии по расследованию несчастных случаев на производстве и конкретизировать в ТК РФ обязанность членов комиссии в несудебном порядке устанавливать лицо, действительно виновное в наступлении несчастного случая на производстве (которым в том числе может быть пострадавший в результате своих виктимных действий), которое, возможно, в судебном порядке будет нести уголовную ответственность за наступление несчастного случая на производстве.
