Обвинительный Акт, Обвинительное Постановление И Обвинительное Заключение Как Итоговые Документы Предварительного Расследования

Abstract

В статье исследуется юридическая природа обвинительного акта и обвинительного постановления. Приводятся данные статистической отчетности Федеральной службы судебных приставов за 2014-2015 гг. о количестве уголовных дел, возвращенных в орган дознания для пересоставления обвинительного акта (постановления). Представлена сравнительная характеристика требований закона к содержанию обвинительных заключения, акта, постановления. В результате анализа используемой законодателем терминологии сделан вывод о необходимости внесения изменений в УПК РФ, предложены варианты решения проблемы.
