Abstract

Статья посвящена актуальным теоретическим вопросам уголовно-правовой характеристики взятки как предмета преступления. Определяются понятие и признаки взятки. Показывается место служебного поведения за взятку в структуре признаков состава преступления. Виды служебного поведения должностного лица, которые описаны в ст. 290 УК РФ как условие получения им взятки, характеризуют предмет данного преступления. Установлено, что между понятиями «предмет взяточничества» и «предмет взятки» наличествуют отношения соподчинения.
