Abstract

В статье ставится вопрос о научной обоснованности институционализации судебного правотворчества в российской правовой системе, делается вывод о существовании де-факто судебного правотворчества, несмотря на отсутствие прямого законодательного закрепления. Анализируются два противоположных подхода в отечественной юриспруденции в связи с постановкой проблемы признания разъяснений и решений высших судебных инстанций формальным источником российского права.
