Исчисление Сроков Обращения Работников За Защитой Трудовых Прав В Административном Порядке

Abstract

В статье анализируются сроки давности обращения работников за защитой трудовых прав в судебном и административном порядке. Обозначаются проблемы, связанные с применением судами ст. 392 ТК РФ к деятельности федеральной инспекции труда. Делается вывод о необходимости установления срока давности обращения работника за защитой трудовых прав в административном порядке, а также закрепления уважительных причин пропуска работником срока давности в ст. 392 ТК РФ.
