О Проблеме Правопреемства В Отношении Деловой Репутации И Иных Нематериальных Благ

Abstract

В статье анализируются возможности защиты деловой репутации и иных нематериальных благ после прекращения существования их обладателей как субъектов гражданского права. Делаются выводы об отсутствии правопреемства в отношении деловой репутации у юридических лиц как при ликвидации, так и при реорганизации, о прекращении существования деловой репутации вместе с правовой личностью ее носителя, но при этом и о возможности связи деловых репутаций разных субъектов. Обосновывается введение понятия «защита положительного и (или) правдивого образа лица» (гражданина или организации).
